President of Ukraine Victor Yushchenko has filed an appeal with the Constitutional Court of Ukraine against the decision of the Verkhovna Rada of Ukraine to call the regular presidential election for October 25 of the current year.

President’s representative to the Constitutional Court Maryna Stavniychuk claimed this to a press conference on Wednesday.

According to the President`s press-office, Viktor Yushchenko asks the Constitutional Court to consider the legitimacy of calling regular presidential elections for October 25.

The President argues that the respective resolution of parliament does not comply with Part 5 of Article 103 of the Constitution. According to the President’s appeal, in line with Part 5 of Article 103, the regular presidential elections following the election of the president on December 26, 2004 and his inauguration on January 23, 2005, must be held, and, thereby, must be set for the last Sunday before January 23, 2010 of the last month of the fifth year of the president`s tenure - for January 17, 2010.

As UNIAN reported earlier, on April 1, the Verkhovna Rada of Ukraine scheduled the next presidential election for Sunday, October 25, 2009.
